Avis - What You Need to Know Before Disputing
Your rental contract is with Avis Alquile un Coche S.A., part of the Avis Budget Group. When you dispute a damage charge in Spain, your actual contact is Van Ameyde, not Avis. Van Ameyde handles the claims processing and sends the liability letters. The most common disputes with Avis involve third-party damage where they charge the renter the full excess instead of pursuing the at-fault driver's insurance.
Known Complaint Patterns
- Ignoring police reports for third-party damage. Avis often charges the renter the full Collision Damage Waiver (CDW) excess even when a police report names an at-fault third party. You can challenge this under Section 6 of their contract, which requires them to use reasonable endeavours to recover costs from the third party.
- Automatic administrative fees. Avis applies a fixed claim processing fee of EUR 40 to EUR 75 per claim. They apply this automatically, regardless of who caused the damage.
- Applying CDW excess to non-fault damage. Avis charges excess amounts ranging from EUR 850 to EUR 3,000 depending on the car group, even if someone else hit you.

Section 6: Third-Party Recovery
Where damage to the Vehicle or Loss is caused by an identifiable third party, Avis will use reasonable endeavours to recover the costs from the third party or their insurer. Where such recovery is successful, any amounts charged to You in respect of that Loss will be refunded, less any irrecoverable costs and administrative charges.
This clause forces Avis to chase the other driver's insurance if you provide their details. If you gave them a police report, they must actively pursue the claim. Charging you the full amount without trying to recover it from the at-fault party breaches this term.
Section 7: Damage Waivers and Excess Avis limits your liability for damage you cause to an excess amount. For an economy car (Group A), this is EUR 850 to EUR 1,100. For a premium car (Group E Plus), it reaches EUR 2,000 to EUR 3,000. The gotcha is that Avis applies this excess even when a third party causes the damage. You can argue this conflicts with Section 6.

- Using pre-authorization to charge disputed amounts. The Consumer Rights Directive (2011/83/EU, Art. 22) requires explicit consent for extra payments. A rental deposit hold does not give Avis consent to charge unspecified damage amounts.
- Unilateral damage assessment. Avis determines the repair costs without letting you verify them. You can challenge this under Directive 93/13/EEC Annex (f) and (l), which restrict terms that let the seller determine if goods conform to the contract.
- Fixed administrative fees. Charging a flat EUR 40 to EUR 75 fee bears no relation to actual administrative costs. Cite Directive 93/13/EEC Annex (e) to argue this is disproportionate compensation.
How to Dispute an Avis Charge - Step by Step
- 1Check your Section 3 compliance. Confirm you reported the accident to Avis and the police within 24 hours. This fulfills your renter obligations and prevents Avis from denying your claim on a technicality.
- 2Email Van Ameyde. Send your dispute to avis@vanameyde.es. State clearly that you dispute the liability. Include the police report and the third party's insurance details.
- 3Cite Section 6. Tell Van Ameyde that Section 6 of the Avis contract requires them to use reasonable endeavours to recover costs from the identifiable third party. Demand proof that they have attempted this recovery.
- 4Challenge the admin fee. If they charged the EUR 40 to EUR 75 processing fee, state that this is arguably unfair under Directive 93/13/EEC Annex (e) because it does not reflect actual costs. Give them 14 days to refund the charge.
Escalation Path If Avis Won't Budge
