Budget Rent a Car (Belgium) uses a third-party company called Sedgwick to handle their damage claims. If you received a surprise bill, you are not out of options. Belgian law gives you specific tools to fight unfair rental charges. The Belgian Civil Code and the Belgian Code of Economic Law override Budget's standard contract terms. You also have protection under the EU Unfair Contract Terms Directive (93/13/EEC, Art. 3), which says terms you did not negotiate are unfair if they put you at a big disadvantage. You have strong legal tools. Here is exactly how to use them.
How Budget Operates in BE
Budget outsources damage recovery to Sedgwick Claims Management Services. Sedgwick often contacts renters by text message or email. They sometimes send these notifications months or even years after the rental ends. They will demand payment but rarely provide the actual signed damage report or repair invoices upfront.
This delay works against them in Belgium. Under the general burden of proof principle, Budget must prove the damage occurred during your specific rental period. A delayed text message from Sedgwick without a joint inspection report fails this legal standard. Furthermore, Budget locations sometimes file an Accident Report without the renter's signature. You can challenge any unsigned damage report as unreliable evidence.
Your Legal Weapons: BE Law vs. Budget's Contract
Budget relies on standard contract clauses to charge you. Belgian law explicitly overrides many of these terms.
The Pickup Inspection Budget claims you accept the vehicle as damage-free unless you note it on the agreement.

You can challenge this under Article 1730 of the Belgian Civil Code. The law requires a detailed, joint condition report (état des lieux). A quick walk-around in poor lighting does not meet this standard. If Budget did not do a detailed joint inspection, Article 1731 presumes you received the car in the exact same condition you returned it.
Unilateral Damage Assessment Budget determines damage costs internally without your input.
"Budget determines damage costs through internal assessment covering: estimated repair cost, diminished value, loss of use, and administrative fees."
This is automatically unfair in Belgium. Under Article VI.83 item 6 of the Belgian Code of Economic Law, a clause where the company solely determines if a service conforms is void. You have the right to challenge their internal assessment.

"Your responsibility for damage to or loss of the car continues until the return location reopens and Budget retakes physical possession of the car."
This transfers all risk to you while the car sits on Budget's property. You can argue this creates a significant imbalance under Article VI.82 of the Belgian Code of Economic Law and EU Directive 93/13/EEC.
Step-by-Step: Dispute Your Budget BE Charge
- 1Send a written dispute. Email Sedgwick at vdcrecovery@Sedgwick.com and Budget Belgium at info@budget.be. State clearly that you dispute the claim.
- 2Demand the joint condition report. Cite Belgian Civil Code Article 1730. Ask for the detailed report signed by both parties at pickup. If they cannot produce one, remind them that Article 1731 presumes you received the car with the alleged damage already present.
- 3Request full documentation. Demand timestamped photos, the signed accident report, and itemized repair invoices. If they only provide an internal estimate, cite Article VI.83 item 6 of the Code of Economic Law to challenge their unilateral assessment.
- 4Challenge administrative fees. If they added fixed admin fees, point out that Article VI.83 item 24 prohibits penalty amounts that manifestly exceed actual foreseeable harm.
